By purchasing any product from DESCHMANN CHIP TUNING (hereafter referred to as Supplier), you are agreeing to the following Terms ans Conditions of Sale.

The following Terms and Conditions of Sale apply to contracts between DESCHMANN CHIP TUNING and its customers for the delivery of goods to its customers.

The contract is concluded when your order (request) has been received and we have accepted the order.

All items remain the property of DESCHMANN CHIP TUNING until payment is made in full.

DATA PROTECTION

The customer is aware and agrees that the personal data required by DESCHMANN CHIP TUNING to execute the contract is stored on data media. The customer expressly consents to collection, processing and use of his or her personal data. All personal data that has been stored is treated by DESCHMANN CHIP TUNING as confidential and is collected, processed and used in accordance with The UK Data Protection Act.

The customer has the right to withdraw his or her consent pursuant at any time with respect to the future. If the customer does so, then DESCHMANN CHIP TUNING must immediately delete the customer’s personal data unless orders from the customer are being processed, in which case the customer data is deleted as soon as order processing has been completed.

SHIPPING INFO - DELIVERY TIME

The item location is United Kingdom, however, items may be dispatched and shipped sometimes from other location of the European Union countries.

We will make every attempt to ship out your order as soon as possible.

Orders placed Monday through Friday by 2:00pm will generally leave our warehouse within 1-14 UK working days

A working day is considered every official working day of the week including Monday to Friday and do not include UK public holidays and weekends.

UK Bank Holidays are not considered working days.

Please do not count the day of order, weekend or UK Bank Holidays as delivery days.

Delays beyond estimated delivery time may occur for the following reasons: postal processing and transport (misrouting), extremely bad weather, local holidays, worker strikes, customs clearance procedures, etc.

If package is taking longer than usual to arrive please allow ample time for delivery and do the following until package has been delivered:

1) See if someone else accepted delivery. Check with household members, neighbors, building managers, the mail room, front desk, and anyone else who may have accepted the delivery.

2) Look for a notice of attempted delivery. You may find an attempted delivery notice in your mailbox or P.O. Box or on your door. Follow the instructions on that notice to request redelivery or pick up the package.

3) Contact the carrier or your nearest post office location. Ask if they have additional information about the package's location. (Have your tracking number handy)

REFUSED SHIPMENTS

Customers who refuse shipments or provide incorrect shipping addresses are required to re-pay shipping costs. If the customer cancels order after shipment is made, the customer is required to pay a 50% restocking fee.

In the event that a customer refuses to accept a shipment due to import duty charges, and the item is returned to Deschmann Chip Tuning, the customer shall be subject to a charge of 50% of the purchase price of the returned item, plus all shipping charges incurred in the shipment and return shipment of the item.

If you deliberately fail to take delivery of the goods (otherwise than by reason of circumstances under control of the Supplier) then the goods shall be returned to the Supplier and a refund or re-credit will be actioned less the shipping costs and less 50% of the item value as s restocking fee incurred by the Supplier.

If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations the Supplier shall refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods, less the shipping costs and minus 50% of the item value as s restocking fee incurred by the Supplier.

Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you as soon as possible.

We must be notified of any discrepancies in delivery contents within 48 hours of receipt by email to [email protected]

DUTIES, TAXES, VAT, CUSTOMS

The buyer is responsible for all fees including duties, taxes, VAT, customs and other charges for items shipped. All property must be shipped at the buyer’s expense. It is each buyer’s sole obligation and responsibility to be aware of, to comply with, and to bear all relevant import duties, taxes, VAT, customs and other fees charged by buyer’s local government and/or tax authority. Deschmann Chip Tuning will ship all packages with the full value of the goods declared. Buyer understands and agrees that Deschmann Chip Tuning shall have no obligation or responsibility for any import duties, taxes, VAT, customs, shipping or other charges for the items shipped.

It is the Buyer’s responsibility to ensure that any property purchased from Deschmann Chip Tuning enters the shipping location lawfully, that all duties and taxes have been paid and that all required export procedures, regulations, and laws were properly complied with. Buyer understands and agrees that Deschmann Chip Tuning shall have no obligation or responsibility for complying with any export procedures, regulations, or laws applicable to the property.

PARTIAL SHIPMENTS

Occasionally your product will be shipped at a different time and it may arrive at different times.

RETURN POLICY

To qualify to return an item under  '14-day Money Back offer' it must be notified to us, sending an e mail on [email protected] within 14 days (7 days for Trade Sales) of delivery as per the Consumer Credit Regulations.

If a unit is returned to us within 14 days (7-day Trade Sales) and found to be faulty a replacement system will be issued or a full refund offered, less the shipping costs.

All products returned must be unused and in new condition.

The customer remains responsible for the cost of returning goods at all times.

Products returned damaged, in unreadable condition will be returned back to the customer.

All returns must be accompanied with a delivery confirmation or signature delivery to show prove of delivery to our address.

In all instances, any return received not conforming to these Terms and Conditions of Sale will not be accepted.

ITEMS DAMAGED IN TRANSIT, RECEIVED DAMAGED OR MISSING CONTENTS

A recipient must report a package that has been damaged during shipment. Report any damaged package immediately to the carrier before accept the parcel.

If the recipient sign the proof of delivery without a note that the package is damaged he loses the liability to claim a refund for damaged in transit parcel.

Present the damaged item and the packaging at a post office for a damage report to be completed.

Customers must retain the damaged article and con­tainer, including the wrapping, packaging, and all contents received.

All claims must be accompanied by ‘Basic Evidence’ as a minimum, claimants must also retain all of the packaging and contents of damaged items or items subject to part loss.

Proof, evidence, and a report have to be made at the courier office that the item was delivered in and re-taped package.

Usually damaged packages are labeled and marked "damaged" and "items may be missing" by the post office or the carrier

The post office or the carries almost always stamp or writes on the package. that it was damaged, delivered empty, etc.

DAMAGED GOODS

If the goods supplied to you are damaged on delivery, you should notify the Supplier in writing an email on [email protected] within 7 days.

If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify the Supplier in writing via email on [email protected] as soon as possible.

If an order arrives damaged, DESCHMANN Chip Tuning can send a replacement out without charge to the customer. However, if the customer decides to cancel the order, the customer will be required to pay a 25% restocking fee.

ORDER CANCELLATION

Order cancelations must be done promptly before and order is shipped. We ship daily so it’s essential email us within hours of placing your order to be able to cancel the order. All cancelations which have been charged are subject to 10% cancelation fee which covers our processing fees.

ORDER ERROR

If merchandise ordered has not been received, please email us within business hours. We will work with you to promptly investigate the location of your order.

PRICING & ERRORS

The descriptions of products in the online shop do not constitute an offer that is legally binding on us, but just a non-binding online catalogue.

Prices are shown and stock availability are subject to change without notice. In the event a product is listed at an incorrect price due to any type of error, DESCHMANN chip tuning reserves the right to refuse or cancel said line item within the order or the entire order. In such case, the customer will receive a credit for the canceled amount.

Important Legal Notice

The customer confirms that he has obtained information about the relevant legal conditions for him, which may be different from country to country, before the conclusion of the deal.

LIMITATION OF LIABILITY

The customer is hereby advised that the use of a DESCHMANN CHIP TUNING can cause oil consumption to rise by as much as 30% and that wear and tear on the vehicle parts increases when supplementary performance is invoked.

DESCHMANN CHIP TUNING reserves the right to make product-related changes with respect to technology, form, colour, weight, and design of the product insofar as such changes or differences are not unreasonable for the buyer in view of the interests of DESCHMANN CHIP TUNING.

While fuel savings are common with our systems they do depend on your driving style, on the serial tolerances of the vehicle engine health, maintenance, fuel quality, climatic conditions and, therefore, cannot be guaranteed.

BHP/HP/PS and torque figures cannot be guaranteed to be exactly the same as stated on our website or any literature produced by DESCHMANN CHIP TUNING but should be similar.

The Supplier shall not be liable for any claim arising out of the performance, non-performance, delay in delivery of or defect in the Goods nor for any special, indirect, economic or consequential loss or damage howsoever arising or howsoever caused (including loss of profit or loss of revenue) whether from negligence or otherwise in connection with the supply, functioning or use of the Goods. Any liability of the Supplier shall in any event be limited to the licence fees paid by the Client in the year in which the event of default arises.

Nothing herein shall limit either party’s liability for death or personal injury arising from the proven negligence by itself or its employees or agents.

The Client shall fully indemnify the Supplier against any liability to third parties arising out of the Client’s use of the Goods.

FORCE MAJEURE

The Supplier will not be liable to the Client for any loss or damage suffered by the Client as a direct result of the Supplier, its sub-contractors or the list-owner from whom the sample or other service or material is derived being unable to perform the Contract in the way agreed by reason of cause beyond its control including, accident, war, riot, lockout, strike, flood, fire, power failure, breakdown of plant or machinery, delay in transit, postal delay, or any other unexpected or exceptional cause or circumstance.

WARRANTY

DESCHMANN CHIP TUNING comprise of a module and wiring harness. In each instance, the module is provided with a two year, non-transferable, warranty.

This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Suppliers instructions, or any alteration or repair carried out without the Suppliers approval.

Your warranty is invalid if a system is found to be to be faulty as a result of water damage, incorrect installation, over adjustment or by any other unreasonable action.

All fitting instructions are supplied as a guide only. DESCHMANN CHIP TUNING will not be held responsible for any damage or injury caused during fitment.

If it is suspected that a system is faulty within the warranty period you must notify DESCHMANN CHIP TUNING as soon as possible via e mial and follow the troubleshooting and return process. As part of this process, you may be asked to provide proof of correct installation, proof of purchase, etc. If the unit is returned and found to be unrepairable a replacement system will be issued.

APPLICABLE LAW

These terms and condition of sale and the supply of the goods will be subject to English law and the English courts and the parties hereby submit to the exclusive jurisdiction of the English courts.
